When to use it
Attach -기에 다름 아니다 to a verb stem, or 에 다름 아니다 to a noun: 항복에 다름 아니다. 다름 is a noun and takes a space.
The claim is an equation: what looks like one thing is really another, and the speaker wants that recognised. 지금 물러서는 것은 포기하기에 다름 아니다.
Now the caveat. 에 다름 아니다 is widely flagged as a calque on Japanese にほかならない, and style guides recommend -(이)나 다름없다 or a plain 바로 -이다 instead.
The native alternative -(이)나 다름없다 says the same thing and raises no objection: 포기나 다름없다. Worth preferring in your own writing.
